North Georgia Wine Trips LLC

Booking Terms, Cancellation Policy, Payment Authorization, and Customer Agreement

Effective Date: January 1, 2026

These Booking Terms, Cancellation Policy, Payment Authorization, and Customer Agreement (“Agreement”) govern every reservation, purchase, tour, transportation service, itinerary, and related service provided by North Georgia Wine Trips LLC (“North Georgia Wine Trips,” “Company,” “we,” “us,” or “our”).

By making a reservation, submitting payment, authorizing another person to make a reservation on your behalf, checking an acceptance box, signing electronically, or participating in a tour, the booking customer and all participating guests agree to be bound by this Agreement.

The person who completes the reservation is referred to as the “Booking Party.” The Booking Party represents that they have authority to make the reservation, authorize payment, accept these terms, and communicate these terms to every guest included in the reservation.

1. Reservations and Booking Confirmation

All reservations must be made through:

  • Our official website;
  • An approved booking or payment platform;
  • A written invoice or payment link issued by North Georgia Wine Trips;
  • Or directly through an authorized North Georgia Wine Trips staff member.

A reservation is not confirmed until:

  • All required booking information has been provided;
  • The required deposit or full payment has been successfully processed;
  • The customer has accepted this Agreement and the applicable cancellation policy;
  • And the Company has issued a booking confirmation.

A pending inquiry, verbal discussion, proposed itinerary, unsigned quote, incomplete checkout, or unpaid invoice does not constitute a confirmed reservation.

The Company may accept, decline, cancel, or condition a reservation when reasonably necessary for scheduling, safety, availability, regulatory compliance, suspected fraud, inaccurate booking information, or operational concerns.

2. Customer Responsibility for Booking Information

The Booking Party is responsible for verifying the accuracy of all reservation information, including:

  • Tour date;
  • Pickup time;
  • Pickup address;
  • Destination or service area;
  • Number of guests;
  • Selected package;
  • Vehicle selection;
  • Contact information;
  • Accessibility requirements;
  • Requested stops;
  • Add-ons;
  • And any special instructions.

North Georgia Wine Trips is not responsible for losses, delays, missed appointments, shortened service, or additional expenses caused by inaccurate, incomplete, or outdated information supplied by the customer.

Any correction or change requested after confirmation is subject to availability and may result in an additional charge.

3. Authority of the Booking Party

The Booking Party represents and warrants that:

  • They are at least 18 years old;
  • They have authority to enter into this Agreement;
  • They are authorized to use the payment method submitted;
  • The payment information provided is accurate;
  • They are authorized to make decisions for the group concerning the reservation;
  • And they will provide all applicable policies to participating guests.

The Booking Party is financially responsible for:

  • The reservation balance;
  • Additional service charges;
  • Overtime;
  • Cleaning or damage fees;
  • Guest misconduct;
  • Unpaid third-party charges advanced by the Company;
  • And other amounts properly due under this Agreement.

When the cardholder and Booking Party are different people, both may be held responsible for amounts they separately authorized or agreed to pay, subject to applicable law.

4. Pricing and Payment

All prices are stated in United States Dollars unless otherwise specified.

Pricing may be based on:

  • Tour package;
  • Number of guests;
  • Vehicle type;
  • Pickup location;
  • Service area;
  • Day of the week;
  • Season or holiday;
  • Tour duration;
  • Winery itinerary;
  • Additional stops;
  • Special requests;
  • And optional add-ons.

The amount shown on the invoice, checkout page, booking confirmation, or written quote controls over general advertising or promotional language.

Full payment or a deposit may be required at booking. Any remaining balance must be paid by the due date shown in the booking confirmation or invoice.

Failure to pay a balance when due may result in:

  • Suspension of itinerary planning;
  • Release of the vehicle or driver assignment;
  • Cancellation of the reservation;
  • Loss of payments already made;
  • Late charges;
  • Or collection activity.

Unless expressly stated otherwise, taxes, gratuities, tasting fees, venue charges, meals, merchandise, and third-party purchases are not included.

5. Payment Authorization

By submitting a payment method, the customer authorizes North Georgia Wine Trips and its payment processor to charge that payment method for:

  • The agreed reservation price;
  • Approved add-ons;
  • Additional authorized service;
  • Overtime;
  • Additional mileage or stops;
  • Cleaning fees;
  • Repair or damage charges;
  • Unpaid balances;
  • Processor fees caused by a returned payment;
  • And other amounts authorized under this Agreement.

Where permitted by applicable law and payment-network rules, the customer further authorizes the Company to use the payment method on file for amounts that become due after the tour, provided that the Company supplies a receipt or written explanation of the charge.

This authorization does not permit the Company to collect the same loss twice. If disputed funds are returned to the Company, any corresponding unpaid-balance claim will be credited accordingly.

6. Package Scope and Included Services

Customers are purchasing only the services expressly identified in their booking confirmation.

General website content, photographs, sample itineraries, prior tours, promotional materials, social-media posts, or discussions about possible destinations do not expand the scope of the purchased package unless expressly incorporated into the customer's written confirmation.

Minimum Transport Package

Unless expressly stated otherwise, a Minimum Transport Package includes transportation and basic itinerary coordination only.

It does not automatically include:

  • Wine tastings;
  • Winery admission;
  • Food or meals;
  • Alcohol;
  • Reserved seating;
  • Private tasting rooms;
  • Venue deposits;
  • Tour-guide gratuity;
  • Driver gratuity;
  • Merchandise;
  • Premium vehicle upgrades;
  • Or optional experiences.

All-Inclusive or VIP Packages

An All-Inclusive or VIP package includes only the particular items identified in the written package description or booking confirmation.

The words “all-inclusive,” “VIP,” or similar promotional terms do not include every product or service available at every venue. Additional purchases made by guests remain their responsibility unless the booking confirmation expressly states otherwise.

7. Third-Party Tasting Fees and Venue Costs

Wineries, restaurants, breweries, distilleries, event venues, and other third parties establish their own:

  • Tasting prices;
  • Admission charges;
  • Reservation deposits;
  • Food and beverage prices;
  • Gratuity policies;
  • Cancellation policies;
  • Age restrictions;
  • Seating requirements;
  • And group policies.

Unless the customer's booking confirmation expressly states that a particular fee is included, the guest is responsible for paying that fee directly to the venue.

A venue's separate charge does not establish that North Georgia Wine Trips misrepresented or failed to provide its transportation or coordination service.

8. Optional Cancellation Insurance

North Georgia Wine Trips may offer optional Cancellation Insurance on a per-person or per-reservation basis.

Cancellation Insurance must be purchased at the time of booking. It cannot be added after the reservation has been confirmed unless the Company expressly agrees in writing.

The Cancellation Insurance fee itself is nonrefundable.

When valid Cancellation Insurance has been purchased:

Cancellation 15 or More Days Before the Tour

The customer may receive a refund of qualifying reservation payments, less:

  • The Cancellation Insurance fee;
  • Nonrefundable third-party deposits;
  • Venue charges already paid;
  • Payment-processing fees that are not returned to the Company;
  • And other clearly disclosed nonrefundable costs.

Cancellation 14 Days or Less Before the Tour

The customer may receive an account credit for qualifying reservation payments, less:

  • The Cancellation Insurance fee;
  • Third-party deposits;
  • Venue charges;
  • Nonrecoverable processing fees;
  • And other nonrefundable costs.

No cash refund is provided for a cancellation made 14 days or less before the scheduled tour.

Unless otherwise stated in writing, account credit:

  • Must be used within 12 months;
  • Is subject to availability;
  • Is not redeemable for cash;
  • May not be sold;
  • And may be applied only once.

Cancellation Insurance does not cover a no-show, removal for misconduct, an unauthorized charge, fraudulent booking information, or refusal to comply with safety requirements.

9. Cancellation Policy Without Insurance

When Cancellation Insurance was not purchased, all reservation payments are nonrefundable.

More Than 14 Days Before the Tour

At the Company's discretion, a customer who cancels more than 14 days before the scheduled tour may receive account credit equal to qualifying amounts paid, minus:

  • Third-party deposits;
  • Venue costs;
  • Payment-processing fees;
  • Administrative expenses already incurred;
  • And other nonrefundable charges.

Issuance of credit is not guaranteed unless stated in the booking confirmation.

14 Days or Less Before the Tour

A cancellation made 14 days or less before the scheduled tour receives:

  • No refund;
  • No account credit;
  • No partial reimbursement;
  • And no transfer of payment to another customer.

All amounts paid are forfeited.

This policy reflects the Company's commitment of vehicles, drivers, scheduling capacity, planning time, winery arrangements, and other resources that are difficult to replace on short notice.

10. No Refunds After Completed or Substantially Performed Service

Once the scheduled transportation or tour has been completed, no refund will be issued merely because a customer:

  • Did not enjoy the experience;
  • Disliked a winery;
  • Disliked a driver's personality;
  • Preferred a different vehicle;
  • Expected services that were not included in the written package;
  • Changed their mind;
  • Disagreed with a venue's pricing;
  • Did not consume all available tour time;
  • Chose not to participate in an included activity;
  • Or was otherwise dissatisfied for subjective reasons.

Completion of the scheduled transportation constitutes delivery of the principal service.

A customer's subjective dissatisfaction does not convert a completed service into a service that was not provided or not received.

This provision does not eliminate any nonwaivable legal rights concerning actual fraud, unauthorized payment, or a material failure by the Company to provide the purchased service.

11. Changes to Reservations

Customers may request changes to:

  • Tour date;
  • Pickup location;
  • Pickup time;
  • Group size;
  • Package;
  • Vehicle;
  • Duration;
  • Or itinerary.

All changes:

  • Must be requested through an authorized Company communication channel;
  • Are subject to availability;
  • May require a written change order;
  • And may result in additional charges.

A requested change is not approved until confirmed in writing by the Company.

North Georgia Wine Trips does not guarantee that changes requested within 14 days of the tour can be accommodated.

A date change may be treated as a cancellation and new booking if the original driver, vehicle, or itinerary cannot be transferred.

12. Group Size and Final Headcount

The customer must provide an accurate final guest count by the deadline stated in the booking confirmation.

Increasing the group size may require:

  • A larger vehicle;
  • An additional vehicle;
  • Additional staffing;
  • Increased venue charges;
  • Or a package-price adjustment.

Reducing the guest count does not automatically reduce the total reservation price after the applicable cancellation deadline.

No vehicle may carry more passengers than its legal or manufacturer-rated capacity.

13. Itineraries and Winery Scheduling

Tour itineraries are estimates and may be changed because of:

  • Winery availability;
  • Traffic;
  • Road closures;
  • Weather;
  • Venue delays;
  • Guest delays;
  • Safety conditions;
  • Reservation changes;
  • Or events outside the Company's reasonable control.

North Georgia Wine Trips does not guarantee:

  • A particular order of stops;
  • A precise arrival time at every venue;
  • A particular table or seating area;
  • Access to a specific employee or wine;
  • Or that every venue will remain open for the entire scheduled period.

The Company may substitute a reasonably comparable venue or adjust an itinerary when necessary.

A reasonable itinerary change does not constitute nonperformance.

14. Pickup Times, Late Arrivals, and Tour Duration

Guests must be ready at the confirmed pickup location at the scheduled time.

Tour time begins at the scheduled start time, not when the final guest enters the vehicle.

Guest lateness may result in:

  • Reduced time at one or more stops;
  • Missed reservations;
  • Removal of a stop;
  • Overtime charges;
  • Or inability to complete the planned itinerary.

North Georgia Wine Trips is not responsible for missed venue reservations or shortened tour time caused by guest lateness.

If the group requests continued service beyond the scheduled end time, overtime is subject to driver availability and will be charged at the Company's then-current overtime rate.

15. No-Shows

A reservation is considered a no-show when the customer or group:

  • Fails to appear at the pickup location;
  • Cannot be contacted within a reasonable period;
  • Provides an inaccessible or incorrect pickup location;
  • Refuses to board after the vehicle arrives;
  • Or fails to satisfy a required balance before service.

A no-show forfeits all payments and receives no refund or account credit.

The Company is not required to extend the tour end time because of a delayed departure caused by the customer.

16. Alcohol, Identification, and Intoxication

Guests must comply with all federal, state, and local alcohol laws and venue policies.

Guests must be at least 21 years old to purchase or consume alcohol.

Valid government-issued identification may be required by wineries, venues, or Company personnel.

North Georgia Wine Trips may refuse transportation or continued service to any guest who:

  • Is dangerously intoxicated;
  • Becomes unconscious or medically unstable;
  • Threatens another person;
  • Interferes with the driver;
  • Attempts to provide alcohol to a minor;
  • Possesses an illegal substance;
  • Or creates an unsafe condition.

The driver has final authority concerning safe vehicle operation.

Removal or termination resulting from prohibited guest conduct does not entitle the customer to a refund.

17. Guest Conduct

Guests must behave respectfully toward:

  • Drivers;
  • Company staff;
  • Winery employees;
  • Venue personnel;
  • Members of the public;
  • Other guests;
  • Vehicles;
  • And property.

Prohibited conduct includes:

  • Violence or threats;
  • Harassment;
  • Intentional property damage;
  • Throwing objects;
  • Tampering with vehicle equipment;
  • Distracting the driver;
  • Standing while the vehicle is moving when prohibited;
  • Smoking or vaping inside a vehicle;
  • Possessing illegal drugs;
  • Exposing oneself;
  • Disorderly conduct;
  • And any conduct reasonably considered dangerous or destructive.

The Company may end the tour, remove a guest, contact law enforcement, or transport the group to a safe drop-off location when reasonably necessary.

No refund or credit will be issued when service is shortened or terminated because of guest conduct.

18. Vehicle Rules

Guests must comply with all vehicle rules and driver instructions.

Unless expressly approved:

  • Smoking and vaping are prohibited;
  • Illegal substances are prohibited;
  • Open flames are prohibited;
  • Guests may not stand while the vehicle is moving;
  • Equipment may not be moved or disconnected;
  • And food or beverages likely to damage the vehicle may be restricted.

Seat belts must be used when required by law or instructed by the driver.

The Booking Party is responsible for communicating vehicle rules to the group.

19. Cleaning and Damage Fees

The Booking Party is responsible for damage, excessive cleaning, contamination, or loss caused by any member of the group.

Charges may include:

  • Excessive cleaning: Minimum $250;
  • Smoking or vaping remediation: Minimum $500;
  • Vomit, blood, urine, or other bodily-fluid remediation: Minimum $500;
  • Broken equipment or fixtures: Actual repair or replacement cost;
  • Upholstery or interior damage: Actual repair or replacement cost;
  • Exterior damage: Actual repair or replacement cost;
  • Lost keys or equipment: Actual replacement cost;
  • Vehicle downtime: Reasonable documented loss of use;
  • Specialized sanitation: Actual third-party expense;
  • And collection or administrative costs related to the damage.

The stated minimum charges represent initial cleaning, sanitation, inspection, and vehicle-removal costs. More extensive damage may result in additional charges.

Photographs, video, inspection records, cleaning invoices, repair estimates, witness statements, and driver reports may be used to establish the condition of the vehicle.

20. Personal Property

Guests are responsible for their personal property.

North Georgia Wine Trips is not responsible for property that is:

  • Lost;
  • Stolen;
  • Left in a vehicle;
  • Damaged at a venue;
  • Or handled by another guest.

The Company may make reasonable efforts to locate and return property. Shipping, delivery, or storage expenses are the customer's responsibility.

Unclaimed property may be discarded or donated after 30 days, subject to applicable law.

21. Weather and Force Majeure

Tours generally operate rain or shine.

The Company may cancel, delay, shorten, reroute, or reschedule service when conditions make performance unsafe, illegal, impossible, or commercially impracticable.

Such conditions may include:

  • Severe weather;
  • Flooding;
  • Ice or snow;
  • Wildfire;
  • Road closure;
  • Vehicle breakdown;
  • Government order;
  • Public emergency;
  • Labor shortage;
  • Driver illness;
  • Venue closure;
  • Utility failure;
  • Civil unrest;
  • Natural disaster;
  • Or another event outside the Company's reasonable control.

When the Company cancels the entire tour before service begins because of such an event, the customer will ordinarily receive either:

  • A rescheduled tour;
  • Or account credit.

A cash refund is not guaranteed when the cancellation results from circumstances outside the Company's reasonable control, except where required by law or expressly stated in the booking confirmation.

22. Third-Party Wineries, Venues, and Businesses

North Georgia Wine Trips provides transportation and coordination but does not own or control independent wineries, restaurants, breweries, lodging providers, entertainment venues, or other businesses.

The Company is not responsible for a third party's:

  • Hours;
  • Prices;
  • Product availability;
  • Service quality;
  • Food;
  • Alcohol;
  • Seating;
  • Reservation decisions;
  • Staffing;
  • Accessibility;
  • Safety practices;
  • Refund policy;
  • Or guest interactions.

A venue may refuse entry, modify its policies, close unexpectedly, or charge additional fees.

Such actions do not automatically constitute a failure by North Georgia Wine Trips to provide transportation.

23. Medical Conditions and Accessibility

Customers must disclose any transportation-related accessibility needs before booking.

The Company will make reasonable efforts to identify an appropriate vehicle or service arrangement but cannot guarantee that every available vehicle or third-party venue will accommodate every need.

Guests are responsible for bringing required medication, mobility aids, and personal assistance.

North Georgia Wine Trips does not provide medical care or medical supervision.

The Company may contact emergency services when a guest appears to require immediate medical assistance. Any resulting medical or transportation expense is the guest's responsibility.

24. Assumption of Risk

Participation in a wine tour may involve ordinary risks associated with:

  • Motor-vehicle transportation;
  • Entering and exiting vehicles;
  • Walking on uneven surfaces;
  • Stairs;
  • Outdoor areas;
  • Alcohol consumption;
  • Crowded venues;
  • Weather;
  • And the conduct of other individuals.

Guests voluntarily assume the ordinary and inherent risks associated with these activities, except to the extent liability cannot legally be waived.

25. Limitation of Liability

To the fullest extent permitted by law, North Georgia Wine Trips will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from:

  • Missed reservations;
  • Lost profits;
  • Lost opportunities;
  • Emotional disappointment;
  • Third-party venue conduct;
  • Weather;
  • Traffic;
  • Guest lateness;
  • Lost property;
  • Or itinerary adjustments.

Except where prohibited by law, the Company's aggregate contractual liability arising from a reservation will not exceed the amount actually paid to the Company for the specific reservation giving rise to the claim.

Nothing in this Agreement excludes liability that cannot legally be excluded.

26. Customer Complaint Procedure

Customers should promptly notify North Georgia Wine Trips of any concern.

When reasonably possible, the customer must provide:

  • The booking name;
  • Tour date;
  • Description of the issue;
  • Relevant photographs or records;
  • Requested resolution;
  • And contact information.

The customer agrees to provide the Company a reasonable opportunity to investigate and respond before commencing external collection, litigation, or payment-dispute proceedings, except where immediate action is legally necessary.

A complaint should ordinarily be submitted within 10 calendar days after the scheduled tour.

Failure to report an issue promptly may impair the Company's ability to investigate the claim.

27. Payment Disputes and Chargebacks

A payment dispute or chargeback occurs when a cardholder asks a bank, card issuer, payment service, or processor to reverse or withhold a payment.

Nothing in this Agreement prohibits a cardholder from reporting actual unauthorized card use, duplicate billing, an incorrect amount, or another legitimate payment error.

However, the customer agrees not to make a knowingly false, misleading, or bad-faith claim concerning a properly authorized charge or a service that was delivered in accordance with the reservation.

Examples of a Wrongful or Bad-Faith Dispute

Subject to applicable law, a dispute may constitute a “Wrongful Dispute” when the customer knowingly claims that:

  • The transaction was unauthorized after personally making or approving the purchase;
  • The service was not received after participating in the tour;
  • The service was canceled by the Company when the customer canceled or failed to appear;
  • The amount was incorrect when it matched the accepted invoice or confirmation;
  • The service was materially different because the customer expected items not included in the written package;
  • A transportation-only package included tasting fees or products that were expressly excluded;
  • A refund was promised when the written cancellation policy stated that the payment was nonrefundable;
  • Or the customer uses a chargeback solely to avoid an agreed cancellation, no-show, cleaning, damage, overtime, or conduct-related charge.

A Wrongful Dispute is a material breach of this Agreement.

Effect of a Reversed Payment

If a bank, card issuer, or processor removes or reverses funds previously paid to the Company, the amount reversed immediately becomes an unpaid contractual balance.

The customer remains responsible for payment for services delivered, reserved capacity, cancellation charges, damage, or other valid amounts merely because a financial institution temporarily or permanently reverses the original payment.

The Company may continue contesting the dispute while also preserving its separate contractual collection rights.

Amounts Recoverable Following a Wrongful Dispute

To the fullest extent permitted by law, a customer responsible for a Wrongful Dispute must pay:

  • The reversed or withheld booking amount, to the extent it has not been restored to the Company;
  • Payment-processor and card-network fees assessed against the Company;
  • Third-party dispute-response expenses, including professional evidence-preparation or chargeback-management services;
  • Documented internal administrative and management time at $350 per hour, billed in quarter-hour increments;
  • Collection-agency fees and collection expenses;
  • Court costs, filing fees, service fees, and enforcement expenses;
  • Reasonable attorney fees, where recoverable by contract or applicable law;
  • Direct and documented operational losses caused by the dispute, including account restrictions, reserve requirements, withheld payouts, processor penalties, or monitoring costs to the extent directly attributable to the customer's Wrongful Dispute;
  • Interest on unpaid amounts at the lesser of 1.5% per month or the maximum rate permitted by law;
  • And any other relief available under applicable law.

The parties acknowledge that responding to a dispute commonly requires management review, retrieval of booking records, preparation of transaction timelines, collection of communications, review of trip records, compilation of photographs or receipts, and submission of evidence under strict deadlines. The $350 hourly rate is intended to compensate the Company for documented management-level time and operational diversion, not to impose a punishment.

No Duplicate Recovery

The Company may not recover the same loss twice.

For example, if the disputed booking amount is returned to the Company by the processor, the Company may not also collect that same principal amount from the customer. Other unpaid fees, administrative costs, attorney fees, collection costs, interest, or documented damages may remain due.

Payment Authorization After a Dispute

Where permitted by applicable law and payment-network rules, the customer authorizes the Company, after written notice, to invoice or charge the payment method on file for legally recoverable amounts arising from a Wrongful Dispute.

The Company may alternatively require payment by certified funds, ACH transfer, or another approved method.

Referral and Legal Action

The Company may:

  • Contest the chargeback;
  • Submit this Agreement and related records to the processor;
  • Refer the debt to collections;
  • Report suspected intentional fraud to the appropriate institution or authority;
  • File a civil action;
  • Seek a judgment;
  • And pursue other lawful remedies.

Withdrawal of a dispute does not automatically eliminate fees or losses already incurred by the Company.

28. Evidence and Business Records

The customer agrees that the following may be maintained and used as business records concerning the transaction:

  • Booking confirmations;
  • Electronic acceptance logs;
  • IP address records;
  • Payment authorization records;
  • Invoices;
  • Receipts;
  • Emails;
  • Text messages;
  • Call notes;
  • Itineraries;
  • Driver logs;
  • GPS or route records;
  • Pickup and drop-off records;
  • Photographs;
  • Video;
  • Venue confirmations;
  • Damage reports;
  • And guest communications.

Electronic records and electronic signatures have the same effect as paper records and handwritten signatures to the extent permitted by law.

29. Collection of Unpaid Balances

Any unpaid amount is immediately due upon written demand unless a different due date is provided.

The Company may use:

  • Internal collection efforts;
  • A collection agency;
  • Legal counsel;
  • Small-claims proceedings;
  • Civil litigation;
  • Liens or post-judgment remedies where available;
  • And other lawful collection methods.

Acceptance of a partial payment does not waive the remaining balance unless the Company expressly agrees in writing that the payment constitutes full settlement.

30. Indemnification

To the fullest extent permitted by law, the Booking Party agrees to indemnify and hold harmless North Georgia Wine Trips, its owners, employees, contractors, and drivers from third-party claims, expenses, losses, or liabilities arising from:

  • Guest misconduct;
  • Guest violation of law;
  • Property damage caused by the group;
  • Injury caused by a group member;
  • Unauthorized use of a payment method by the Booking Party;
  • False information supplied during booking;
  • Or breach of this Agreement.

This provision does not require indemnification for liability that cannot legally be transferred.

31. Governing Law and Venue

This Agreement is governed by the laws of the State of Georgia, without regard to conflict-of-law rules.

To the extent permitted by law, any lawsuit relating to a reservation or this Agreement must be brought in:

  • The state courts located in Gilmer County, Georgia;
  • Or the federal court serving that county.

The customer consents to personal jurisdiction and venue in those courts.

Before filing suit, the parties should make a good-faith attempt to resolve the issue through written communication.

32. Jury-Trial and Class-Action Waiver

To the fullest extent permitted by law, each party knowingly and voluntarily waives the right to a trial by jury for a claim arising from this Agreement or reservation.

To the fullest extent permitted by law, claims must be brought individually and not as a plaintiff or class member in a purported class, collective, representative, or consolidated action.

This section does not apply where such a waiver is prohibited or unenforceable.

33. Severability

If any provision of this Agreement is found unlawful or unenforceable, that provision will be enforced to the maximum extent legally permitted or severed if necessary.

The remaining provisions will remain in effect.

A court may modify an overbroad provision to the extent permitted by law so that it most closely reflects the parties' lawful intent.

34. No Waiver

The Company's failure or delay in enforcing a provision does not waive its right to enforce that provision later.

A one-time exception, courtesy credit, reschedule, or refund does not create an obligation to provide the same accommodation in another case.

Any waiver must be in writing and expressly authorized by the Company.

35. Entire Agreement

This Agreement, together with the customer's:

  • Booking confirmation;
  • Invoice;
  • Package description;
  • Approved change orders;
  • And written addenda,

constitutes the entire agreement relating to the reservation.

It supersedes prior oral statements, informal discussions, advertisements, and representations concerning the same reservation.

If there is a direct conflict, the customer-specific booking confirmation controls concerning the selected package, date, time, and price. This Agreement controls concerning general policies unless the customer-specific document expressly states otherwise.

36. Policy Updates

North Georgia Wine Trips may update these terms for future reservations.

The version accepted when the customer books will ordinarily govern that reservation unless:

  • The parties agree to a written modification;
  • A change is required by law;
  • Or the update concerns a safety or operational requirement that must be implemented immediately.

Updated terms will be posted on the Company website with a revised effective date.

Required Customer Acknowledgment

By completing the reservation, the Booking Party confirms:

I have reviewed and agree to the North Georgia Wine Trips LLC Booking Terms, Cancellation Policy, Payment Authorization, and Customer Agreement. I understand the package I selected, what is and is not included, the applicable cancellation deadline, the no-refund policy, the guest-conduct requirements, and my responsibility for damage, cleaning, overtime, unpaid balances, and wrongful payment disputes. I authorize payment in accordance with these terms and confirm that I am permitted to use the payment method submitted.

Cancellation Acknowledgment

I understand that, unless I purchase applicable Cancellation Insurance, all payments are nonrefundable, cancellations within 14 days receive no refund or credit, and no refund will be issued after the tour has been completed merely because a guest was dissatisfied.

Chargeback Acknowledgment

I understand that knowingly disputing an authorized payment or falsely claiming that a completed service was not received is a material breach. If funds are reversed, the valid unpaid balance remains due, together with legally recoverable processor fees, documented administrative time billed at $350 per hour, collection costs, direct damages, interest, and reasonable attorney fees.
